Dear Friends,

The Board of Commissioners tonight voted to postpone until Dec. 2 the public hearing on the proposed rezone for nine acres just east of the blind curve on Daniells Bridge Road so the county's public works department can draw up plans showing the county's hoped for improvements of Daniells Bridge Road between the Oconee Connector and Lynn Drive, which is at the center of the curve itself.

The Board took the action after the public hearing had been advertised and more than a dozen citizens showed up to speak against the rezone. The date for the public hearing also had been set in legal documents the county filed to settle a lawsuit filed against it when it turned down the rezone in May of 2007.

The county does not release any details of its executive sessions during which it discusses legal issues with County Attorney Daniel Haygood. The decision to try to settle the lawsuit almost certainly had been agreed upon by the BOC members in one such session.

County Public Works Director Emil Beshara also indicated tonight he had met with commissioners at the site in recent months to discuss the project. If he met with three commissioners at the same time--a quorum of the Board--such a meeting would be a violation of the state's open meetings laws since the public was not informed in advance.

Any improvements in Daniells Bridge Road that end at Lynn Drive would not solve the problem of the blind curve itself. The proposed rezone is for an office park just east of the blind curve.

I'll put a fuller report on the meeting on my blog later in the week. I wanted to make sure you knew the outcome of tonight's meeting in advance.
